DOJ says States Can't Cut Services at Will

A review of recent Justice Department Briefs indicates that the feds will enforce the Integration Mandate. "Cutting and/or eliminating community services and supports will be unsuccessful,” says Diane Rovi, Policy Manager at the Independent Living Resource Center San Francisco. “The Department of Justice is actively supporting the civil rights of persons with disabilities to live in their communities and not be forced into segregated facilities based on budgetary problems.”
"Recent filings by the Department of Justice in Olmstead cases provide a snapshot of the type and amount of action the current administration is taking in order to enforce the Integration Mandate," says Herb Levine, Executive Director of ILRCSF. "This is especially telling as it relates to the impact of state budget problems on community services and supports. This is not a legal review of the cases involved."
